These Terms of Service ("Terms") govern your use of Apexed at https://apexed.online and related services ("Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Apexed provides tools for merchants to train an AI assistant with business knowledge and optionally connect a Facebook Page to automate Messenger replies to customers. Each merchant is responsible for the accuracy of their training data and for communications sent through their connected channels.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and authorized to represent the business you register. You must comply with all applicable laws and with Meta Platform Terms when using Facebook or Messenger features.
3. Acceptable use
You agree not to use Apexed to:
- Operate illegal businesses or promote illegal products or services.
- Send spam, unsolicited bulk messages, or deceptive content via Messenger or other channels.
- Harass, threaten, or impersonate others.
- Upload training content that is violent, exploitative, or unrelated to a legitimate business.
- Attempt to bypass security, abuse APIs, or interfere with the Service.
We may suspend or terminate accounts that violate these rules or pose risk to the platform, other users, or Meta compliance.
4. Facebook / Meta
Connecting a Facebook Page requires authorization through Meta. You grant Apexed permission to access Page data and Messenger messages solely to provide the Service. You must maintain admin access to the Page and comply with Meta's policies. Meta may revoke access independently of Apexed.
5. AI-generated content
Replies are generated from your training data and may be inaccurate or incomplete. You are responsible for reviewing critical communications and configuring escalation rules. Apexed does not provide legal, medical, or financial advice.
6. Privacy
Our collection and use of data is described in the Privacy Policy.
7. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of liability
To the maximum extent permitted by law, Apexed shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.
9. Changes and termination
We may modify the Service or these Terms. We may suspend or terminate access for violation of these Terms or for operational reasons. You may stop using the Service and request data deletion as described in our Data Deletion Instructions.
